Nestopar Premium – Pay-Per-View Terms & Conditions
A. Producer / Media House / Content Creator Terms
1. Eligibility & Authorization
- Only verified Producers, Media Houses, or Content Creators (“Partners”) authorized by Nestopar can upload premium (paid) content.
- Authorization requires submission of valid business documents, including GST number (if applicable in India), bank account details for payouts, and government-issued ID and entity details for compliance.
- Nestopar reserves the right to accept or reject any Partner or content submission.
2. Content Compliance
- Partners are solely responsible for ensuring that their content complies with all laws and government regulations, including IT Act, Copyright Act, Cinematograph Act, etc.
- Certification requirements (such as CBFC certification) remain the Partner’s responsibility.
- Partners must guarantee that they own or control all rights to the uploaded content.
3. Pricing & Availability
- Partners may choose the price for their content within Nestopar’s approved range.
- Users who pay for content will have access until the Partner removes it.
- Partners must provide 30 days’ prior written notice before content removal. During this notice period, Nestopar will display a message to users indicating that the content will leave in 30 days.
- If a Partner removes content without notice, Nestopar reserves the right to withhold earnings for that content.
4. Revenue Share & Payment Terms
- From each transaction: App Store / Play Store commission is deducted, applicable taxes (GST/TDS) are deducted, Nestopar charges a 20% platform fee, and the remaining balance is credited to the Partner.
- Payments are cleared within 30 days of the end of the purchase month, provided the Partner reaches the minimum payout threshold of ₹1,000.
5. Taxes & Invoicing
- Partners are responsible for their own tax compliance.
- Nestopar will issue transaction statements and applicable invoices.
- Incorrect GST details will result in denial of ITC claims, for which Nestopar is not responsible.
6. Rights & Usage
- Partners grant Nestopar a limited license to stream, promote, and distribute their content.
- Nestopar may use trailers, thumbnails, and metadata for promotion.
- No exclusivity is required unless a separate agreement applies.
7. Refunds & Chargebacks
- User refunds or chargebacks will be adjusted against Partner’s earnings.
- Nestopar may withhold payments in cases of fraud or violations.
8. Termination & Removal
- Partners may remove content only with a 30-day notice period.
- Nestopar may suspend or remove content that violates laws, policies, or generates repeated complaints.
9. Indemnity & Liability
- Partners indemnify Nestopar against legal claims related to their content.
- Nestopar’s liability is limited to the Partner’s net revenue share.
B. Viewer / User Terms for Pay-Per-View
1. Purchase & Access
- Viewers may purchase content via Nestopar Premium at the listed price.
- Payment grants streaming access as long as the content remains available on Nestopar.
- If the Partner removes content, access will end after the announced 30-day notice period.
2. Viewing Rules
- Purchased content is available for streaming only; downloads/offline viewing are not permitted unless expressly offered.
- DRM may be applied to prevent piracy.
3. Refund Policy
- Purchases are non-refundable, except in cases of technical failures or fraudulent transactions.
- Approved refunds will be credited using the original payment method.
4. Device & Account Restrictions
- Content may be streamed on a limited number of devices as per Nestopar’s policy.
- Sharing purchased access outside the registered account is prohibited.
5. Content Availability
- Content may be removed by the Partner with 30 days’ advance notice.
- Nestopar is not liable for content being unavailable after the notice period.
6. User Conduct
- Users must comply with all laws and Nestopar community guidelines.
- Piracy, screen capture, or redistribution will result in suspension and possible legal action.
7. Termination of Access
- Nestopar may revoke access if fraud, misuse, or legal/regulatory violations are detected.
